Terms and Conditions of Service

1. Introduction
These terms govern the provision of the Stay Foodie service by SC DIGITAL BOMORE MARKETING COMPANY, SL to the restaurants that subscribe to the platform. The subject of the contract is access to a SaaS booking service for restaurants that includes an embeddable widget, a public page, an admin panel, a diner CRM and automated communications. The current version is the one published on this page dated 3 June 2026.

1. Purpose
Stay Foodie is a software-as-a-service (SaaS) booking management service for restaurants, provided by SC DIGITAL BOMORE MARKETING COMPANY, SL from the domain stayfoodie.com. The service includes an embeddable widget for the restaurant's website, a dedicated public page, an admin panel to manage bookings, tables, rooms, shifts and team, a basic diner CRM and automated communications by email and SMS. The client, for the purposes of these terms, is the restaurant that subscribes to the plan and will act as data controller in respect of its own diners' data.
2. Acceptance
By registering an account, subscribing to a plan or using any functionality of the service, the client fully accepts these terms together with the linked Privacy Policy and Cookie Policy. Acceptance is considered to be made by the natural person who creates the account, who must have sufficient legal capacity and authority to bind the restaurant. If these terms are not accepted, the service must not be used. Material changes to the terms are notified by email at least 30 days in advance, with a right to cancel without penalty if they are not accepted.
3. Account and registration
Using the service requires registering an account by providing truthful, complete and up-to-date information about the restaurant and the responsible person. Credentials (email and password) are personal and non-transferable: the client is responsible for keeping them secure and for any activity carried out under their account. We recommend enabling the two-step verification available in the panel. Any unauthorised access or suspected compromise must be reported immediately to hola@stayfoodie.com so that the account can be suspended and a password reset forced.
4. Trial period and subscription
Registration includes a 30 calendar day trial period with no card required, with access to all the functionality of the chosen plan. After the trial, to continue using the service it is necessary to subscribe to one of the available plans, with a flat monthly or annual fee and no per-cover commission. Billing is recurring and renews automatically at the start of each period until the client cancels from the panel. During the trial no charge is made and the account can be deleted at any time with no commitment whatsoever.
5. Payments and pricing
Payments are processed through Stripe, a PCI-DSS certified provider that handles the card data — Stay Foodie does not store or directly access that data. Published prices may include or exclude VAT depending on the client's tax location; invoices are issued with the corresponding breakdown. Fees may be updated at any time, with notice given by email at least 30 calendar days in advance. If the new price is not accepted, the client may cancel before it comes into force without penalty; continued use after the indicated date implies acceptance of the new fee.
6. Cancellation and refunds
The subscription can be cancelled at any time from the admin panel, with no minimum term and no early cancellation penalty. Cancellation takes effect at the end of the period already billed: the service remains active until that date and no pro-rata refunds are issued for unused days. Refunds are contemplated only in two scenarios: charges incurred during the trial period due to a technical error, and periods during which the service was unavailable due to causes attributable to Stay Foodie above the committed SLA. Client data is retained for 30 days after cancellation in case the client decides to reactivate.
7. Acceptable use
The service must be used exclusively for the purposes of managing the bookings of the subscribing restaurant. The following are expressly prohibited: carrying out illegal activities or activities that infringe third-party rights, attempting to access data from other tenants or the internal infrastructure, performing unauthorised scraping of the panel or the API, abusing usage limits of the API or of the sending of communications, and reselling or transferring access to the service without written authorisation. Breach may lead to immediate suspension of the account and, in serious cases, to termination of the contract without any right to a refund.
8. Intellectual property
The Stay Foodie brand, the stayfoodie.com domain, the source code, the designs, the texts, the logos and any other element of the service are the property of SC DIGITAL BOMORE MARKETING COMPANY, SL or its licensors, and are protected by Spanish and European intellectual and industrial property law. Subscribing to the service grants a non-exclusive, non-transferable licence to use it, limited to the subscription period. The client retains full ownership of the data they enter into the platform (bookings, diner profiles, configuration) and can export it at any time in standard formats.
9. Limitation of liability
The service is provided "as is" and "as available", applying reasonable professional diligence. Stay Foodie commits to a service level (SLA) of 99.5% monthly availability measured on the admin panel and the booking widget, excluding scheduled maintenance windows that have been announced in advance. In the event of an SLA breach, the client is entitled to compensatory credits applied to the next invoice, according to the scale published in the documentation. Save where legislation imposes liability that cannot be limited, Stay Foodie does not respond for indirect damages, loss of profits or loss of opportunity arising from temporary failures.
10. Applicable law and jurisdiction
These terms are governed by Spanish law. For any dispute arising from the interpretation or performance of the contract, the parties expressly submit to the Tribunales de Palma de Mallorca, except where the matter concerns a consumer domiciled elsewhere in the European Economic Area, in which case the non-waivable jurisdiction granted by consumer protection legislation will prevail. Before resorting to the courts, the parties undertake to attempt an amicable solution by contacting through hola@stayfoodie.com for a reasonable period of at least 30 calendar days.
